1. Parties
This Membership Agreement ("Agreement") is concluded electronically between the current operator of the makinateklif.com platform ("makinateklif.com", the "Platform" or the "Operator") and the natural or legal person who registers on the Platform ("Member"). By approving this Agreement during the registration process, the Member is deemed to have accepted all of the provisions of this Agreement.
2. Definitions
Platform: the listing and quote service provided via the makinateklif.com domain and related applications.
Member: a user who creates an account by registering.
Listing: an announcement of machinery, equipment, vehicles or similar goods/services published by a Member.
Quote: a price/terms proposal exchanged between Members regarding a listing.
Store / Membership Package: paid add-on features and quotas.
3. Subject and Scope
This Agreement governs the rights and obligations of the parties with respect to the Member publishing listings, sending/receiving quotes, messaging, opening a store and using other services. makinateklif.com is an intermediary service provider and is neither the seller nor buyer of the goods/services in listings, nor a party to transactions between Members.
4. Membership and Account
Information provided for membership must be accurate, current and complete.
Account security and password confidentiality are the Member's responsibility; the Member is liable for transactions made through the account.
Persons under 18 or lacking legal capacity may not become members.
makinateklif.com may suspend or terminate accounts that breach the rules.
5. Member's Rights and Obligations
The Member undertakes to act in accordance with applicable law, public morality and this Agreement.
Misleading, unlawful, infringing or false listings/content may not be published.
The Member who posts a listing is solely responsible for the accuracy, quality, availability and price of the product.
The Member may use other users' personal data only for lawful contact purposes and may not carry out unsolicited marketing.
6. Creation and Management of Listings by the Platform
If the Member creates a store or registers on the Platform, makinateklif.com may create listings on behalf of the Member, edit, update, and publish existing listings using product and company information provided by the Member to the Platform or obtained from publicly available sources, for the purpose of promoting the Member's store and its products/services more effectively on the Platform.
Listings created within this scope may include content such as product name, description, technical specifications, category, brand, images, contact information, and company information. The creation of a listing does not establish any sales, representation, agency, or similar relationship between the Member and makinateklif.com.
By registering on the Platform or creating a store, the Member is deemed to have authorized makinateklif.com to use information relating to the Member's company and products/services for the purpose of creating and publishing listings for the purposes stated above.
The Member may review listings created on their behalf through the Platform and may request that such listings be corrected or removed. The Member's explicit request to remove listings shall be fulfilled within a reasonable period, unless there is a legal or technical obligation preventing such removal.
The Member acknowledges and represents that they have the necessary rights to use the content they provide to makinateklif.com or request to be published, and that such content does not infringe the intellectual property, personality, or other rights of any third party.
makinateklif.com does not guarantee the accuracy of the listings it creates. If the Member determines that any information concerning their products or services is inaccurate or untrue, the Member is obligated to notify makinateklif.com.
7. Effectiveness
This Agreement enters into force upon the Member's electronic approval. makinateklif.com may update it; the current version is published on this page.
6. makinateklif.com's Rights and Obligations
It uses reasonable efforts to maintain the services but does not warrant uninterrupted or error-free operation.
It may review listings before/after publication and decline to publish or remove non-compliant content.
It may change the scope, features and fees of the services upon prior notice.
8. Fees and Membership Packages
Basic membership is free. Certain services such as featured placement, extra listing quotas and stores are paid. Fees for paid services are stated at the time of purchase and collected via a licensed payment institution (iyzico). Withdrawal rights and invoicing are applied within the framework of consumer legislation and the . The sale terms and right of withdrawal for paid services are further governed by the .
9. Intellectual Property
All intellectual property rights in the Platform's design, software, brand and content belong to makinateklif.com or its licensors. The Member represents that it holds the necessary rights to the content it uploads and grants makinateklif.com the license required to publish such content.
10. Limitation of Liability
makinateklif.com is not a party to the communication, negotiation, quote or sale relationships between Members and cannot be held liable for damages arising therefrom, for the accuracy of listing content or for defects in the goods/services. Its liability is limited to the maximum extent permitted by law.
11. Term and Termination
The Agreement remains in force for the duration of membership. The Member may terminate it at any time by closing the account. makinateklif.com may terminate immediately upon breach or unlawful use. Termination does not extinguish accrued payment obligations.
12. Privacy and Data Protection
The Member's personal data is processed under the .
13. Force Majeure
In events beyond the parties' control (natural disaster, fire, epidemic, cyber-attack, infrastructure and communication outages), the affected party is not liable for non-performance during such period.
14. Governing Law and Disputes
This Agreement is governed by the laws of the Republic of Türkiye. The [City] Courts and Enforcement Offices have jurisdiction. For consumer transactions, Consumer Arbitration Committees and Consumer Courts are competent within the applicable monetary limits.
